Terms of Service

These terms are an agreement between you and The Send Labs, a unit of Homeasy Automation Private Limited, a company incorporated in India (CIN U74909BR2025PTC073219) with its registered office at B-Hub, 5th Floor, Mauryalok Complex, Patna 800001, Bihar, India ("The Send Labs", "we", "us"), for the use of the website thesendlabs.com and The Send Labs service. By creating an account or using the service you accept these terms, our Acceptable Use Policy and, for business customers, our Data Processing Agreement. Our Privacy Notice explains how we handle personal data.
If you accept these terms for a company or other organisation, you confirm that you are authorised to bind it, and "you" means that organisation.
1. Eligibility
You must be 18 or older and able to enter into a binding contract under the Indian Contract Act, 1872.
2. The service
The Send Labs warms up email mailboxes you connect, measures where emails land, runs inbox placement tests, monitors domain settings, recommends improvements and sends alerts. You can also write emails in the app, check and test them, and, once we have turned sending on for your account, send them one by one from your own connected mailboxes.
Whether emails reach the inbox depends on many things outside our control, including how mailbox providers filter mail, your sending practices, your content and your recipients. We do not guarantee any inbox placement, deliverability rate or business result.
3. Free early access
The service is currently offered free of charge as "early access". During early access:
- each account may start up to 200 new warmup emails a day, shared by all of its mailboxes, plus a monthly number of spam tests shown in the app;
- we may change these limits, or end early access, with at least 30 days' notice by email;
- paid plans will only start after we tell you their prices and you choose a plan. Nothing is charged without your explicit agreement.
4. Your account
- Give accurate information and keep it up to date.
- Keep your password secret. You are responsible for everything done under your account.
- Tell us at once at [email protected] if you suspect unauthorised access.
5. Mailboxes, domains and the warmup network
- Connect only mailboxes and domains that you own or are authorised to use, and keep that authorisation.
- You authorise The Send Labs to log in to each connected mailbox, send warmup emails from it, and find, read, move, flag and file The Send Labs' own warmup and test emails in it.
- Mailboxes with warmup on take part in The Send Labs warmup network: they send warmup emails to, and receive and answer warmup emails from, other mailboxes in the network, including other customers' mailboxes. These emails are filed away automatically.
- You may disconnect a mailbox or turn warmup off at any time.
- If you add warmup emails of your own, they are sent only to The Send Labs' seed mailboxes. You are responsible for their content, which must follow the Acceptable Use Policy; we may stop any of them.
5A. Sending emails from the app
- Sending is available only after we turn it on for your account, and we may turn it off at any time if we see a risk to recipients, mailbox providers, the warmup network or other customers.
- You are the sender. Emails go from your own mailbox, in your name. You decide what to send and to whom, and you are responsible for having the recipients' consent or another lawful reason to email them, for the content, and for following the anti-spam and data protection laws that apply to you and to your recipients.
- Each recipient gets a separate email. A mailbox may send at most 200 emails a day, warmup emails included, and one send may go to at most 50 recipients. We may change these limits with notice.
- Every email carries an unsubscribe link and header that you cannot remove, and your postal address. People who unsubscribe are never emailed again from your account.
- You authorise The Send Labs to send these emails from your connected mailboxes on your instruction and to keep a record of each email sent (recipient, time, result) for 90 days.
6. Acceptable use
You must follow the Acceptable Use Policy. In short: no spam, phishing, malware, fraud, purchased or scraped lists, or anything unlawful, and no interfering with the service or the network. We may suspend or end accounts that break it, with or without notice where the risk to others requires.
7. Your data
You keep all rights to your data. You give us a limited licence to process it only to provide and improve the service, as described in the Privacy Notice and, for data of other people, the Data Processing Agreement. You can download or delete your data at any time from Account.
8. Our rights
The Send Labs, its software, content and trademarks belong to us or our licensors. These terms give you a right to use the service, not ownership of it. Do not copy, resell, reverse engineer or build a competing service from it.
9. Availability and changes
We aim to keep The Send Labs available, but do not promise uninterrupted or error-free service. We may change or discontinue features. We will give reasonable notice of changes that materially reduce the service.
10. Disclaimer and liability
To the extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind.
To the extent permitted by law, our total liability for all claims relating to the service is limited to the greater of the fees you paid us in the three months before the claim arose and INR 5,000. We are not liable for indirect, incidental or consequential loss, including lost profits, lost business, or emails filtered as spam.
Nothing in these terms limits liability that cannot be limited by law.
11. Indemnity
You will compensate us for losses arising from your breach of these terms or the Acceptable Use Policy, or from mail you send using mailboxes or domains you connect.
12. Suspension and termination
You may delete your account at any time from Account → Delete account. We may suspend or terminate your account if you breach these terms, if required by law, or if your use creates a risk to the service or others. On termination we delete your data as described in the Privacy Notice.
13. Changes to these terms
We may update these terms. We will publish the new version here and email you about material changes at least 30 days before they take effect. If you keep using the service after that, the new terms apply.
14. Law and disputes
These terms are governed by the laws of India. The courts at Patna have exclusive jurisdiction, subject to any right you have under the Consumer Protection Act, 2019.
